1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of fortmyersbeach.org and any related pages, forms, and services (the “Site”), operated by the Greater Fort Myers Beach Area Chamber of Commerce (“the Chamber,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

We may update these Terms at any time. Changes take effect when posted, and the “Last updated” date above will reflect the revision. Continued use of the Site after changes are posted means you accept the updated Terms.

2. About the Chamber

The Chamber is a membership-based organization that promotes Fort Myers Beach as a visitor destination and supports local businesses. Information on the Site is provided for general informational and promotional purposes only.

3. Visitor Information Disclaimer

The Site includes information about businesses, accommodations, restaurants, attractions, events, beach conditions, parking, and island access. This information is compiled from member submissions, public sources, and third parties, and may change without notice.

We do not guarantee that any listing, price, hours of operation, event date, availability, or condition described on the Site is accurate, current, or complete. Events may be rescheduled or canceled by their organizers. Always confirm details directly with the business or event organizer before making travel plans.

4. Member Listings and Third-Party Businesses

Business listings, deals, and directory entries reflect current Chamber membership and are not endorsements, certifications, or guarantees of quality, licensing, safety, insurance, or performance. Any transaction, reservation, or agreement you enter into with a listed business is solely between you and that business. The Chamber is not a party to those transactions and is not responsible for any dispute, loss, injury, or damage arising from them.

Members are responsible for the accuracy of the content they submit for publication and for ensuring they have the rights to any images, logos, or text provided.

5. Membership

Membership applications, dues, benefits, renewal, and termination are governed by the Chamber’s membership policies and bylaws, which are separate from these Terms. Membership dues are generally non-refundable except as stated in those policies. The Chamber reserves the right to approve, decline, suspend, or terminate membership at its discretion.

6. Events, Registration, and Payments

Where the Site allows registration for events, sponsorships, advertising, or membership payments, you agree to provide accurate information and to pay all applicable fees. Payments are processed by third-party payment providers subject to their own terms; the Chamber does not store full payment card data. Refund and cancellation terms for a specific event or program are stated at the point of purchase, and where none are stated, fees are non-refundable.

7. Links to Other Sites

The Site contains links to third-party websites, including member sites, booking platforms, and government or tourism resources. We do not control and are not responsible for the content, accuracy, availability, security, or privacy practices of those sites. Links are provided for convenience only and do not imply endorsement.

8. Acceptable Use

You agree not to:

• use the Site for any unlawful purpose or in violation of these Terms;
• submit false, misleading, defamatory, infringing, or offensive content;
• harvest, extract, or systematically collect content, listings, images, or contact information from the Site by automated means without our written permission;
• attempt to gain unauthorized access to the Site, its servers, or related systems;
• interfere with the operation, security, or performance of the Site;
• reproduce or resell Site content or directory data for commercial purposes without permission.

9. User-Submitted Content

If you submit content to the Site — including listing information, photos, event details, reviews, comments, or form submissions — you represent that you own or have the right to share it, and you grant the Chamber a non-exclusive, royalty-free, worldwide license to use, reproduce, adapt, display, and distribute that content in connection with promoting Fort Myers Beach and the Chamber’s activities, including on our website, social channels, and printed materials. We may edit, decline, or remove any submission at our discretion.

10. Intellectual Property

Unless otherwise noted, the Site and its content — including text, graphics, photography, video, logos, and design — are owned by the Chamber or its licensors and are protected by United States and international copyright and trademark law. The Chamber’s name, logos, and marks may not be used without prior written permission. You may view, download, and print Site content for personal, non-commercial use only.

11. Copyright Complaints

If you believe content on the Site infringes your copyright, please contact us at info@fmbchamber.com with a description of the work, the location of the material on the Site, your contact information, and a statement of good-faith belief that the use is unauthorized. We will review and respond, including removing material where appropriate.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect information submitted through the Site.

13. Accessibility

The Chamber is committed to making the Site usable by as many visitors as possible and works toward conformance with WCAG 2.1 Level AA where reasonably practicable. 14. Disclaimer of Warranties

The Site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Your use of the Site and reliance on its content is at your own risk.

15. Limitation of Liability

To the fullest extent permitted by law, the Chamber, its directors, officers, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, travel expenses, or business opportunity, arising out of or related to your use of the Site, reliance on its content, or dealings with any business or organization listed on it. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100.00) or the amount you paid to the Chamber through the Site in the twelve months preceding the claim, whichever is greater.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless the Chamber and its directors, officers, employees, volunteers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your content submissions, or your violation of these Terms or applicable law.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Lee County, Florida, and you consent to that jurisdiction and venue.

18. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Chamber regarding the Site.
